Please read these Terms carefully. Section 17 contains a binding arbitration agreement and a class action waiver that affect your legal rights. You may opt out of arbitration within 30 days.

1. Who we are

This website, nurestia.com (the "Site"), is operated by Nurestia, a business registered in Belgium, with its registered address at 5000 Namur, Belgium ("Nurestia", "we", "us", "our").

Throughout the Site, the terms "we", "us" and "our" refer to Nurestia. By visiting the Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein.

These Terms apply to all users of the Site, including browsers, customers, merchants and contributors of content. If you do not agree to all of these Terms, you may not access the Site or use any Service.

2. Eligibility

  • You must be at least 18 years old, or the age of majority in your state of residence, to place an order.
  • You represent that the information you provide is accurate, current and complete.
  • We currently ship to addresses within the United States. We do not accept orders from states or territories where our products may not lawfully be sold.
  • You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws of your jurisdiction in using the Service.

3. Changes to these Terms

We reserve the right to update, change or replace any part of these Terms by posting updates to the Site. It is your responsibility to check this page periodically. Your continued use of the Site after changes are posted constitutes acceptance of those changes. Changes will not apply retroactively to orders already placed.

4. Products and descriptions

We make every effort to display our products, colors and images as accurately as possible. We cannot guarantee that your device's display accurately reflects the actual color of a product.

All products are subject to availability. We reserve the right to discontinue any product at any time, and to limit the quantities of any products we offer to any person, household, geographic region or jurisdiction.

Product descriptions, weights, dimensions and images are provided for general information. Occasional errors, inaccuracies or omissions may occur; we reserve the right to correct them and to update information at any time without prior notice.

5. Cosmetic and personal care products

Our products are cosmetic and personal care products. They are not drugs or medical devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and they are not a substitute for professional medical advice.

Always read the label and any instructions supplied with the product. Perform a patch test before first use. Discontinue use and consult a physician if irritation occurs. If you are pregnant, nursing, taking medication, or have a medical condition, consult your physician before use.

Individual results vary. Any testimonial, review or result shown on the Site reflects the experience of that individual and is not a guarantee that you will obtain the same outcome. See our Disclaimer.

6. Pricing and currency

  • All prices are displayed in United States Dollars (USD, $) unless otherwise stated.
  • Prices are exclusive of applicable sales tax, which is calculated and displayed at checkout where we are required to collect it.
  • Prices are subject to change without notice. The price applied to your order is the price displayed at the time your order is accepted.
  • Where a reference price is shown (for example "was $44.99"), that price is a bona fide price at which the item was offered for a substantial period of time, or the manufacturer's suggested retail price.
  • In the event of an obvious pricing error, we reserve the right to cancel the affected order and issue a full refund, even after an order confirmation has been sent.

7. Orders and acceptance

Your order is an offer to purchase. Our order confirmation email is an acknowledgement that we received your order — it is not acceptance of your offer. A contract is formed only when we dispatch the products to you.

We reserve the right to refuse or cancel any order, in whole or in part, at our sole discretion, including where we suspect fraud, a pricing or description error, an unauthorized reseller, or a violation of these Terms. If we cancel an order after payment has been taken, we will refund you in full.

8. Payment and billing

  • We accept the payment methods displayed at checkout. You represent that you are authorized to use the payment method provided.
  • Payment is captured at the time of purchase.
  • Your card or bank statement will show the descriptor NURESTIA.COM. If you do not recognize a charge, please contact us before disputing it with your bank; we can usually resolve it within one business day.
  • You agree to provide current, complete and accurate purchase and account information for all purchases.

9. Shipping, title and risk of loss

Shipping times, carriers and costs are described in our Shipping Policy, which forms part of these Terms.

Some of our products are shipped from fulfillment partners located outside the United States. Delivery timeframes reflect this and are disclosed before you complete your purchase.

Title and risk of loss pass to you upon our delivery of the products to the carrier.

10. Returns and refunds

Our Refund & Return Policy forms part of these Terms and describes your return window, the condition items must be in, who pays return shipping, and how and when refunds are issued.

11. Promotions, discounts and free gifts

Promotional codes, bundles and free-gift offers are subject to their stated conditions, cannot be combined unless expressly stated, have no cash value, and may be withdrawn at any time. Where a free or discounted item is received as part of a bundle, returning part of the bundle may reduce the refund by the value of the benefit received.

12. Electronic communications, email and SMS

By providing your email address, you consent to receive transactional emails relating to your order. You may separately opt in to marketing emails and can unsubscribe at any time using the link in every message.

SMS: if you provide your mobile number and expressly opt in, you consent to receive recurring automated marketing and order-related text messages from Nurestia at that number. 13. Reviews, comments and other submissions

If you send us creative ideas, suggestions, reviews, photos or other materials ("Submissions"), you grant us a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, publish and display them in any medium, including in advertising. You represent that your Submissions are your own, are accurate, do not infringe any third-party right, and do not contain unlawful, defamatory or obscene material.

We do not compensate reviewers for positive reviews and we publish reviews without editing their substance. Where a reviewer received a product free of charge or an incentive, that fact is disclosed alongside the review.

We may, but are under no obligation to, monitor, edit or remove Submissions at our sole discretion.

14. Prohibited uses

In addition to the prohibitions set out elsewhere in these Terms, you are prohibited from using the Site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to infringe any intellectual property right; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to scrape, spam, phish or crawl; or to interfere with the security features of the Site. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

15. Intellectual property

All content on the Site — including text, graphics, logos, images, photographs, video, product names and the mark NURESTIA™ — is the property of Nurestia or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute or create derivative works from it without our prior written permission.

16. Disclaimer of warranties; limitation of liability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. The Service and all products delivered to you through the Service are, except as expressly stated by us, provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by law, Nurestia, its directors, officers, employees, affiliates, agents and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost data or loss of goodwill, arising from your use of the Service or any products procured through it.

Our total aggregate liability arising out of or relating to any order shall not exceed the amount you actually paid for that order.

Some states do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. In those states, our liability is limited to the maximum extent permitted by law, and nothing in these Terms limits liability for fraud, gross negligence, personal injury or death caused by our negligence, or any liability that cannot be excluded by law.

17. Dispute resolution — arbitration and class action waiver

Please read this section carefully. It affects your rights.

Informal resolution first. Before filing a claim, you agree to contact us at contact@nurestia.com and give us 60 days to resolve the dispute informally. Most issues are resolved at this stage.

Binding arbitration. If we cannot resolve the dispute informally, you and Nurestia agree that any dispute, claim or controversy arising out of or relating to these Terms or your purchase shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this provision. The arbitration will take place in the county of your residence or, at your election, by telephone or video, or based on written submissions.

Class action waiver. You and Nurestia agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property rights.

30-day right to opt out. You may reject this arbitration agreement by sending written notice to contact@nurestia.com within 30 days of your first purchase, stating your name, address and a clear statement that you wish to opt out of arbitration. Opting out has no effect on any other part of these Terms and will not affect your relationship with us.

18. Governing law

These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Nothing in this section deprives you of the protection of the mandatory consumer protection laws of the U.S. state in which you reside, which continue to apply in your favor.

19. Severability, waiver and entire agreement

If any provision of these Terms is held unlawful, void or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions. Our failure to exercise or enforce any right shall not constitute a waiver of that right. These Terms, together with the policies posted on the Site, constitute the entire agreement between you and us and supersede any prior agreements.

20. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, labor disputes, carrier delays, customs holds, governmental action or failures of telecommunications or payment networks.
